By purchasing from Foundation Wellness and any of its brands, including but not limited to PowerStep®, CURREX®, and Foot Petals®, you acknowledge and agree to the following Terms and Conditions.

RESELLER POLICY:

We have developed the PowerStep® ProTech™ Line for medical professionals and their patients. A medical professional is defined as any physician, podiatrist, hospital, chiropractor, physical therapist or certified pedorthist that attends to patients in a medical setting.

Foundation Wellness brands resellers, or customers of those resellers, agree not to list products for sale on any online discount store or marketplace (ebay.com, NewEgg.com, Bonanza.com, Walmart.com, Amazon.com, Rakuten.com, etc.).

Violations of these policies shall be determined by Foundation Wellness at its sole discretion. Foundation Wellness may unilaterally and without further warning, discontinue selling products to and terminate its business relationship with such dealer, distributor, or provider.

PRICING POLICY:

The Minimum Advertised Price (MAP) for all products is set to be the same as the Manufacturer's Suggested Retail Price (MSRP). This policy is designed to protect reseller margins, support Foundation Wellness brands as a premium offering, and avoid destructive intra-brand channel conflict.

Guidelines:

  1. The advertised price for Foundation Wellness brand products shall not be below the Manufacturer’s Suggested Retail Price (MSRP) listed on the most recent price list.
  2. The pricing policy applies to all advertisements of Foundation Wellness brand products in any and all media, including, without limitation, fliers, posters, coupons, direct mailers, brochures, newspapers, magazines, catalogs, public signage, other print media, television, radio, e-mail, websites, e-commerce, social media platforms, and other digital media. The pricing policy is not applicable to any in-store advertising that is not distributed to any end customer. Free shipping and/or handling or free financing promotions do not violate the pricing policy.
  3. This policy applies only to advertised prices and does not apply to the price at which the products are actually sold or offered for sale to an individual consumer within the dealer, distributor, or retailer’s retail location. Resellers, distributors, and retailers remain free to sell these products at any price they elect.
  4. This pricing policy is not a contract or agreement, and Foundation Wellness does not seek, nor will it solicit or accept any dealer, distributor, or retailer agreement with our policy; nor will we discuss your pricing or the pricing of others. This policy is a unilateral policy upon which Foundation Wellness is willing to market its products, and sales personnel have no authority to modify or grant exceptions. The terms of this policy are confidential and may not be disclosed to other parties.
  5. Violations of the policy shall be determined by Foundation Wellness at its sole discretion. Foundation Wellness may unilaterally and without further warning, discontinue selling products to and terminate its business relationship with such dealer, distributor, or provider.

PURCHASES AHEAD OF PRICE INCREASE: During the notice period for price increases, customer order amounts could be limited based on normal monthly ordering patterns. Foundation Wellness reserves the right to refuse monthly orders in excess of 115% of dealer purchases from Foundation Wellness for the previous 12 months ahead of any announced or anticipated price increase. Calculations will be based on a rolling 12-month calendar.

DISPUTE POLICY:

Foundation Wellness is committed to providing high-quality products and services. Any disputes, including but not limited to issues related to defects, shortages, billing discrepancies, mis-shipments, or other concerns, must be submitted in writing and received no later than five (5) business days prior to the invoice due date. All dispute-related correspondence should be directed to contact@foundationwellness.com.

AUTHORIZED RESELLER RETURN POLICY AGREEMENT:

As an authorized reseller, you agree to honor and fully comply with the standard 60-day return policy offered to customers. This policy allows customers to return eligible products within sixty (60) days of the original purchase date for a refund or exchange, in accordance with the return guidelines provided.

Customers are encouraged to try the product, and as such, used or worn items must be accepted as valid returns, provided they are returned within the 60-day window and in accordance with product return standards.

Resellers may report customer returns to Foundation Wellness Customer Service for credit or replacement products, subject to approval and in accordance with the established return processing procedures. Requests should be sent to contact@foundationwellness.com.

Failure to uphold this return policy may result in review of your reseller status and potential termination of your authorization.

RETURNED GOODS POLICY:

All returns must be authorized in advance by Foundation Wellness Customer Service. A Return Authorization (RA) must be obtained prior to returning any merchandise. Unauthorized returns may be refused or returned at the sender’s expense.

  • Eligible Returns: Items can be returned 60 days from the date of invoice. Only unused merchandise in its original packaging is eligible for return, and only upon approval by Customer Service.
  • RA Validity: Approved Return Authorizations are valid for 30 calendar days from the date of issuance. Merchandise must be received within this time frame to be eligible for return.
  • Return Window & Restocking Fees:
    • Returns received within 30 days of the original invoice date (with a valid RA) are eligible for full credit.
    • Returns received between 31 and 60 days from the invoice date are subject to a 20% restocking fee, deducted from the credited amount.
    • Freight Charges: Return shipping costs are the responsibility of the customer.
